I’ve mentioned before the cavalcade of Trump horrors, too many to list. Just from today’s headlines: An FCC that ruins a program to help poor people get on the Internet. Promotion of conservative media monopolies. Elephant trophy hunting.

But this. This. This might be the worst yet. Think Progress writes about it. It’s about the powerful conservative legal group, the Federalist Society, with a breathtaking court-packing idea. They would create dozens of new district and appellate level federal courtships — to be filled at lightning pace by the compliant Senate of course — to counteract any remaining tendencies on the part of judges to follow more moderate inclinations. It is described forthrightly as a means to “undo the judicial legacy” of Barack Obama.

Oh, they’ll talk workload. The same people who stalled and delayed and defied Barack Obama appointees up to and including the U.S. Supreme Court. Including the likes of Sen. Tom Cotton, who blocked a batch of appointments to an important claims court under the pretext that they weren’t needed (really because he was advancing the special interests of a former employer.)

If America holds a free and fair election in 2020, and if Democrats regain control of the government after that election, they would have no incentive not to respond to Calabresi’s proposal with their own court-packing legislation — perhaps even legislation that adds several new justices to the Supreme Court.

That’s a big IF. And of course it would be hypocritical, but that doesn’t seem much of a bar to anything political these days.
