No, school board members can't legally trade e-mails about a proposed slate of school board officers.

Thus held Sebastian Circuit Judge Stephen Tabor, the Fort Smith School Board violated the state Freedom of Information Act in doing so. The exchange of substantive information by e-mail amounts to a meeting. Meetings must be announced and, if material is discussed that may be discussed in secret, the board must first vote to do so.

The judge said the board should not again meet without giving proper notice.
