The Senate today defeated, on a vote of 11-14, SB 373 by Sen. Bart Hester
to exempt communications between an attorney and a public client from the Freedom of Information Act. The vote was expunged so it could come up again.
The bill was written to apply to pending or "threatened" litigation, but critics have said it could likely be used to shield vast amounts of information from the public. Defenders of the legislation also have been hard-pressed to show where the law has been used to the detriment of public institutions.
