UPDATE: An arrest warrant has been issued over the allegation of sexual assault by a Maumelle band director.
Maumelle police are investigating a Maumelle High
band director for sexual assault of a female band member.
A police report, first reported by KTHV, said the student "had a crush" on the band director and did not have a problem with actions the band director took. A friend reportedly told a parent, triggering a report to the Crimes Against Children Division.
CORRECTION: Jim Hansard of the Maumelle police said the initial report by KTVH, and repeated here, that a charge was filed was incorrect. The police have completed an affidavit seeking a warrant for an arrest on second-degree sexual assault, he said. A Maumelle district judge will review the affidavit and he'll decide whether there's probable cause for a charge to be filed. The teacher, who has denied inappropriate touching, has been suspended pending completion of the investigation.
The girl, now in 12th grade, said the director had put his arm around her as early as the 10th grade and had occasionally hugged her and squeezed her butt in the years since. In July 2015, she said she was the last student to leave a band practice and she was hugging the teacher when he pulled her blouse and bra down from the neckline and sucked her left nipple for 20 to 25 seconds, according to the police report. Asked if other things had happened, she said only the things she'd mentioned in the beginning. She said she did not have a problem with the things he did and felt like it was "their little thing." She said she felt flattered by his attention.
The police report said the teacher denied any improprieties but said he'd once been the subject of an allegation at another school, in 1999 According to the police report, that accusation involved kissing the breast of a student. No charge was filed. The report said the family didn't want to follow through with a complaint.
UPDATE: Maumelle police said Wednesday that a warrant had been issued by district court for the arrest of the teacher, Carl Mouton, 54, on a felony charge of second degree sexual assault. Arrangements were being made with his attorney for a court appearance.
A police spokesman said he'd have an initial court appearance today and bond would be set. It's expected to be $15,000. Another court appearance is scheduled May 24, the spokesman said.
