Milligan files complaint with prosecutor

State Treasurer Dennis Milligan, now with his right arm in a sling, filed a complaint this morning with the Pulaski County Prosecuting  Attorney's Office asking that lawyer Luther Sutter be charged with 3rd degree battery.

Luther and Sutter got into an argument at the Mitchell Williams law firm yesterday morning before Milligan was to be deposed in a defamation suit filed against him by former employee David Singer. Singer is represented by Sutter. Police were called just after 9 a.m. to the law firm, where Milligan said Sutter entered the deposition room swearing and said "shit" in front of Tina Milligan, the treasurer's wife. When Milligan asked Sutter to stop using bad language in front of his wife, he told police, Sutter summoned him to the end of table and pushed him in the chest. 

Sutter told police he was afraid Milligan was going to attack him, and that Milligan pushed him back, though other witnesses did not confirm that.

Police advised Milligan contact the prosecutor. Battery in the 3rd degree is a Class A felony misdemeanor by a year in jail and a fine of up to $2,500.

Milligan staffer Grant Wallace said the treasurer went to the doctor yesterday after the incident and was given the sling. He is taking the day off to recuperate. Wallace said he assumed Milligan would be back at work tomorrow.
