The 8th U.S. Circuit Court of Appeals
today allowing trial of a lawsuit over a 2008 fatal shooting by Morrilton police of a man suspected of taking a bottle of whiskey.
Officer Clint Murray shot Jermell Thompson after he was reported to have driven away from a liquor store with a stolen half-gallon of Crown Royal. Two police cars attempted to stop him. Thompson was shot by Murray. He'd gotten out of his vehicle and said he feared for his life when Thompson's car drove toward him.
The 8th Circuit refused Murray's claim of immunity and also refused to dismiss the city of Morrilton from the case. The court said it didn't have jurisdiction to question the district court's determination that there was sufficient difference in accounts for a jury to decide whether the officer deserved immunity in his use of force.
