Late last night, after more than six hours of deliberation,
C.D. SPANN: Acquitted on murder charges.
a Saline County jury acquitted C.D. Spann of murder charges in the 2013 deaths of Donald and Michael Williams. They'd been riding all-terrain vehicles on his property in the Sardis community.
Spann said he'd called authorities about the riders and believed he had authority to detain them. He said he shot one of the brothers when he pointed a gun at him and then shot the other because he had a shotgun and felt threatened. He said he was sorry for what happened. He also said he suspected them of thefts on his property.
The Benton Courier has a full report
, including tension in the courtroom and the detention of a spectator.
I asked Prosecutor Ken Casady
about the case:
It was a close case that I felt the jury needed to decide. The defendant claimed self defense, our surviving witness told the police otherwise. The jury evaluated the credibility of each. I respect their decision. The fact that two of our law enforcement personnel, whose names arose in the course of the trial, had pending legal problems might have also raised some doubts.
