Jeffrey Toobin provides the early word on arguments today at the U.S. Supreme Court on a challenge to the federal Defense of Marriage Act. The law is in trouble, he says. Swing Justice Anthony Kennedy is troubled by the federal law's infringement on states rights in the way it discriminates against people from states that have legalized same-sex marriage.
This could change dramatically, of course, when Kennedy learns the Arkansas legislature has voted its endorsement of DOMA. That's set to come later today in a House resolution vote.
