Hate crime statute upheld in Arkansas case

The 8th Circuit U.S. Court of Appeals today upheld the conviction of Frankie Maybee, convicted of joining in harassment of Latinos at an Alpena convenience store in June 2010 and eventually causing a wreck that injured five men. Store video captured Maybee beginning the pursuit after saying he was going to catch the "fuckin' spicks" and "beat the shit out of them." Accomplices also provided testimony that, after Maybee forced the sedan off the road and it burst into flames, he stated that he hoped the “fuckin’ beaners burn and die.”

The court upheld the sufficiency of the evidence and also rejected Maybee's argument that the hate crime statute was unconstitutional. He was sentenced to more than 11 years in prison.
