Appeals court upholds EPA greenhouse gas rules

A three-judge panel of the U.S. Court of Appeals in Washington, including hard-right Republican David Sentelle, has ruled that the Environmental Protection Agency was “unambiguously correct” in issuing rules aimed at reducing industrial emissions linked to global warming.

Mitt Romney has been a critic of Obama administration rule-making. The corporate lobby opposes the rules. Wrote the Wall Street Journal:

In Tuesday's ruling, the appeals court upheld the EPA's auto-emissions rules and rejected industry-backed challenges to the agency's permitting requirements for power plants and other stationary sources of pollution.

"The existence of some uncertainty does not, without more, warrant invalidation of an endangerment finding," the court wrote.
