A Twitter from Breaking News says Judge Tim Fox has set a $1.1 billion penalty on Johnson & Johnson and a subsidiary for deceptive trade practices and Medicaid fraud in dispensing the anti-psychotic medication Risperdal in Arkansas without adequate warning of side effects. A jury found the companies liable yesterday. It was left to the judge to establish a penalty today. Most of the penalty was for Medicaid fraud.
This is a big win for Attorney General Dustin McDaniel. And even after the hefty attorney fee for the national lawyer who's bringing these actions for states around the country, it should leave a big chunk of change to meet expected Arkansas Medicaid program shortfalls. But, first, there will be appeals. No money to count just yet.
