If you're interested in the long-running and convoluted case by Northwest Arkansas developer Thomas Terminella against Metroplitan National Bank and related parties over a foreclosed development loan, suffice it to say he was rebuffed thoroughly on an appeal today by the Arkansas Supreme Court. The ruling, among others upheld a sanction against Terminella and his attorney for bringing an action barred by the statute of limitations.
Also at the Supreme Court today:
* REVERSAL: The Court reversed Judge Chris Piazza's ruling in a lawsuit by Attorney General Dustin McDaniel that a Utah law firm had charged illegal fees in excess of those allowed by statute for collecting bounced checks. The Supreme Court agreed with the law firm that its fees for law practice were distinguishable from those allowed by the state deceptive trade practices act.
