Charge coming in Pearcy shooting



A reader asked for an update in the case of the Pearcy man who shot and killed another man allegedly driving away from his home on a stolen ATV.

The Garland County sheriff's office is still keeping details closed as it completes its investigation. Prosecutor Steve Oliver of Hot Springs said today he had not received the file. But he reiterated that he expected to charge the shooter. He cited established law that a homeowner, though not required to retreat, must feel threatened before using deadly force on his property. He also said that the shooter and dead man were lifelong friends and that there was evidence that the shooter knew the identity of the person on the vehicle when he fired. "It's not about the four-wheeler," Oliver said.

Oliver said he'd received a substantial amount of communication from people who believe -- as many of our readers apparently do -- that you may legally take another's life if they steal property. That isn't the law.
