Could it possibly be constitutional to prohibit court appeals of PSC and PC&E decisions on power plants? Sen. Barbara Horn (D-SWEPCO) seems to think so. Surely power company lawyers helped her write her proposal to accomplish that, so they might have some idea.
No court appeals? Imagine what a corrupt governor could make off appointments to regulatory bodies with that sweeping authority, no matter how wrong-headed the decisions.
