The Arkansas Supreme Court today upheld a lower court ruling that Wal-Mart had come up with a legal way to have a retail liquor store on the premises of its Sam's Club in Fayetteville. It's established as a separate operation from the warehouse store, though it clearly benefits from its side-by-side location.

As law now stands, Wal-Mart isn't able to replicate this setup at other stores in Arkansas. It may own only one liquor store. But alcohol has become a big profit center for discount retailers and I'd bet work will continue to figure out ways to expand the footprint in states like Arkansas, where it hasn't been allowed previously.

The court rejected equal protection and other arguments raised by an association of retail liquor stores challenging the permit.
