The Arkansas Supreme Court ruled today that Circuit Judge Victor Hill (pictured) had no power to call a special grand jury to investigate the West Memphis police shooting of a child. The court said another court division, which had appointed a special prosecutor who found police blameless, currently had exclusive jurisdiction.
Two justices raised questions about whether Hill might have been able to act had the special prosecutor’s work been completed. But they accepted at face value the special prosecutor’s assertion that he had received new evidence that was under review and, thus, the case was not closed.
