Federal Judge Jim Moody today dismissed the lawsuit brought by former Sen. Bill Walker, now state workforce education chief, over his daughter Alysson's failure to make the cheerleading squad at Central High School. Moody said the Walkers had not exhausted administrative remedies by seeking an independent hearing of their complaint from the state Education Department. He also said that while Walker's daughter was disabled by attention deficit disorder, there had been no showing that she had been denied participation in an activity on account of that disability. The opinion notes that Walker's daughter -- recently featured in MTV's reality series on fabulous Sweet 16 parties -- was schooled alongside peers at Central, including in advanced placement classes.
Here's Judge Moody's opinion issued with his order dismissing the case on summary judgment.
