This is not a directly analagous case. But check this 5th U.S. Circuit Court of Appeals decision on the censure of a judge in Texas. The court says that he cannot be censured for the content of his speech at a news conference (which came in a pending case in which he was involved) though he could be disciplined for using a courtroom and wearing judicial robes to deliver a message.
Applicable in the case of Wendell Griffen? Not technically, since we're in a different judicial circuit. Applicable in general? You decide.
