Laywers for the ACLU made their case this morning before the Arkansas Supreme Court that it should uphold a judge who said the state ban on gay foster parents was unconstitutional ....A deodorant manufacturer says Little Rock is the No. 21 "Sweatiest City in the U.S." .... Asa! and Mike Beebe! will join LR School District officials this Friday afternoon at Wakefield School when Democrat-Gazette publisher Walter Hussman passes out $429,000 from his foundation to Wakefield teachers as rewards for student improvement in test scores over the last year.

 

UPDATE: The oral arguments. Our witness says the case against the gay foster parent ban seemed to go reasonably well for the ACLU position. Sharp questioning from several justices (Brown, Corbin, Imber) on the state's lame justification for singling out gay people (and now trying to argue it's about cohabitation) when the regulation makes no such provision for heterosexuals.

UPDATE II: We heard that Justice Tom Glaze isn't participating in this close, a blow to the good guys. He has a lot of experience in foster care law, for one thing. For another, Gov. Huckabee -- who appointed all members of the board defending this mean rule -- got  to appoint his replacement and they've generally been conservative Republicans. He already has one judge on the court, Betty Dickey. Prognosticators don't see a good vote from Jim Gunter, either, who ran with help from the Huckabee organization. If the ACLU side gets Brown, Imber and Corbin (and that's still an if), it could leave Chief Justice Hannah as the swing vote. Anybody with more judicial prognosticating, feel free to pitch in.
