ADEQ proposes fine for former agency chief

The Arkansas Department of Environmental Quality today announced a proposed settlement of multiple pollution violations by Poseidon Energy Services, a company headed by former ADEQ Director Marcus Devine.

Here's the proposal.

In it, he would promise to correct deficiencies at his operating facility, including cracks in a containment berm, clean up sludge and other pollutants from his company's salt water disposal facility in White County in the Fayetteville shale and pay a $14,400 fine.

Some of the problems were detailed in this report. Devine has also come under scrutiny from the state Oil and Gas Commission over injection well practices and has been cited previously by ADEQ.

I don't know yet if Devine will accept the proposal or contest it.

Is it too late to ask for an audit of the agency's work during the years Devine headed it?
